Terms of Use

1. Broker-Consumer Relationship

By registering for and using the RCIB Home Search website ("the Site"), you acknowledge that you are entering into a lawful broker-consumer relationship with RCIB Real Estate Limited, Brokerage ("RCIB"), a registered real estate brokerage in Ontario, Canada. This relationship is governed by the Trust in Real Estate Services Act, 2002 (TRESA) and all applicable regulations.

2. Personal, Non-Commercial Use Only

All MLS® listing data and information provided through this Site is intended exclusively for your personal, non-commercial use. By accessing listing data, you agree that:

  • You will use the data solely for your own personal reference and consideration
  • You will not use the data for any commercial purpose whatsoever
  • You will not use the data for any purpose other than the consideration of purchase, sale, or lease of individual properties

3. Bona Fide Interest

By registering for an account and accessing listing data on this Site, you confirm and represent that you have a bona fide interest in the purchase, sale, or lease of real estate of the type being offered through this Site. You acknowledge that access to listing data is provided exclusively for this purpose.

4. Restrictions on Use of Listing Data

You agree that you will not copy, redistribute, retransmit, or otherwise use any listing data or Listing Information provided through this Site except in connection with your consideration of the purchase, sale, or lease of an individual property. Without limiting the foregoing, you specifically agree that you will not:

  • Copy, reproduce, or redistribute listing data in any form or by any means
  • Retransmit or forward listing data to any third party
  • Use listing data for any purpose other than the consideration of purchase, sale, or lease of individual properties
  • Directly or indirectly display, post, disseminate, distribute, publish, broadcast, transfer, sell or sublicense any Listing Information
  • Engage in "scraping" (including "screen scraping" and "database scraping"), "data mining", or any other activity intended to collect, store, re-organize, summarize or manipulate any Listing Information or any related data
  • Use automated systems (including bots, spiders, crawlers, or AI tools) to collect, harvest, or extract listing data
  • Store or compile listing information for purposes of creating a database or listing service
  • Merge listing data with data from other sources for commercial purposes

5. PropTx Ownership and Copyright

You acknowledge and agree that PropTx Inc. ("PropTx") is the owner and holds the copyright in the MLS® database, MLS® data, and PropTx's MLS® System. All MLS® listing data is provided under license from PropTx and its member brokerages. The listing data remains the exclusive property of PropTx and its members, and all rights are reserved. No ownership interest in the data is transferred to you through your use of this Site.

6. No Scraping, Data Mining, or Unauthorized Collection

You agree that you will not scrape, data mine, or use any automated processes to collect, store, or redistribute listing information provided through this Site. Any unauthorized collection or use of listing data is strictly prohibited and may result in immediate termination of your account and legal action.

7. PropTx Audit and Compliance Access

You expressly authorize PropTx and other PropTx Members to access this Site (including the VOW operated by RCIB) for the purposes of verifying compliance with PropTx rules, policies, and the VOW Datafeed Agreement. This includes but is not limited to:

  • Auditing user accounts and registration information
  • Reviewing access logs and search history
  • Verifying that listing data is displayed in compliance with PropTx rules
  • Ensuring that all terms and conditions are being adhered to

By using this Site, you consent to such audits and compliance verification activities.

8. Privacy and Information Sharing

Your personal information, including but not limited to your name, email address, phone number, and Site usage data, may be shared with PropTx for the purposes of:

  • Auditing compliance with VOW rules and policies
  • Legal proceedings related to misuse of listing data
  • Verifying the lawful broker-consumer relationship
  • Ensuring the integrity and security of the MLS® System

9. Registration and Account Security

You must register with accurate and truthful information. You are responsible for maintaining the confidentiality of your account credentials. RCIB may suspend or terminate accounts that violate these terms. For security purposes:

  • Email verification is required before accessing listing data
  • Passwords expire every 90 days and must be renewed
  • Sessions will time out after 60 minutes of inactivity
  • All access is logged for compliance and audit purposes

10. Listing Data Accuracy

Property listing data is provided by the PropTx VOW Datafeed. Information is deemed reliable but not guaranteed accurate by PropTx or RCIB. RCIB makes no warranties regarding the accuracy, completeness, or timeliness of listing information. You should independently verify any information that is important to your transaction decisions.

11. Disclaimer

The information provided herein must only be used by consumers that have a bona fide interest in the purchase, sale, or lease of real estate and may not be used for any commercial purpose or any other purpose. THE SITE AND ALL LISTING DATA ARE PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED.

12. Limitation of Liability

RCIB Real Estate Limited, Brokerage shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising from the use of this Site or reliance on listing information.

13. No Financial Obligation or Representation Agreement

These Terms of Use do not impose any financial obligation on you (the Consumer) and do not create any representation agreement between you and RCIB Real Estate Limited, Brokerage. Your use of this Site is provided at no cost and does not constitute an exclusive or non-exclusive buyer or seller representation arrangement.

14. Termination

RCIB reserves the right to terminate or suspend your account at any time, without notice, for any violation of these Terms of Use or for any reason related to compliance with PropTx rules and policies.
